Procedure for legalization of stay

1. Procedure in brief

Instructions on this cyan-colored rectangle is specified for students in this Insitute. Students in other institutions, please check them in your cases.

Below are general processes. Two times you have to pay by yourself (340+50 zł).

In this Institute, students have right to apply for reimbursement of the cost for this payment depending on which Ph.D. program they are registered. For this reimbursement, you have to write an application and submit it to the director of the institute after receiving your own residence card.
Boldfaced points below are related to reimbursement procedure.

Attention!

  • Students who are 1/4 part-time employed by the Institute can apply for this reimbursement.
  • Students who are registered in MPD program cannot. They can apply for reimbursement for the cost of visa to visit partner-countries in their program.
  • Students who are registered in other programs, ask your supervisor about it.

Detailed process and necessary documents are described in the following Procedure in detail.

  1. Preparation of application documents
    Make a copy of the 340 zł (+2.5 zł for remittance) payment receipt (dowód wpłaty) for yourself before you submit the original receipt to the office.
  2. Submission
    The most important point is the fact that you submitted (and the office accepted) your application at least 45 days before the expiration of your present visa or residence permit.
  3. Submission of additional documents (optional)
    Sometimes Mazowsze Province Office sends you a recorded delivery letter and requires you to submit additional documents.
  4. Receive a letter about "Decision (Decyzja)"
    You will receive a recorded delivery letter about "Decision" process from Mazowsze Province Office.
  5. Paying 50 zł for residence card and receive the "Decision"
    Pay 50 zł for issuing your residence card and
    make a copy of the receipt.
    Visit the office and pass the payment receipt. Then you will receive the "Decision" document.
  6. Renew your registration in Warsaw Capital City Office (Zameldowanie) It's your flat's owner's business. Ask yours to do it.
    If you stay in students hostel, Ms. Aleksandra (room 42 in building 9, [map]) will do it.
  7. Receive the residence card (karta pobytu)
    Visit the office again and pass a copy of your new "zameldowanie" document and show your passport.
    Then you will receive your own plastic residence card (karta pobytu).
  8. Procedure inside Institute
    Prepare application documents and submit them to Ms. Aleksandra (room 42 in building 9, [map]. Then director of the Institute will judge about reimbursement.

2.1 Preparation of application documents
The instruction says basic required documents are
  1. application with 3 copies
  2. 4 colour photographs sized 45mm × 35mm
  3. Valid travel document (passport), 3 photocopies + original document for verification
  4. Confirmation of registration for temporary residence (zameldowanie na czas określony)
  5. Legal title to the apartment (rent contract is enough)
Additional documents for Ph.D. students, corresponds to cases of beginning or continuing full-time studies or daytime doctoral studies in the instruction.
  1. Certificate confirming the admission to or continuing the studies issued by the entity in charge of the studies
  2. Proof of the fee payment for the studies
    ( Regulations, Sec. 1.4.2 says "Both full-time and extramural studies are free of charge". It can be proven by student certification with a sentence "Studia są nieodpłatne".)
  3. Documents confirming the availability of the funds to cover the costs of living and return, and to cover the costs of the studies - document from the Institute giving information about your scholarship (amount of money you get is important)
  4. Documents confirming health insurance taken up (you will be able to get it from Institutes administration)
Additional documents for Post-docs corresponds to case of taking up a job in the instruction
  1. Work permit on the territory of the Republic of Poland for the period of stay on the basis of the permit or visa
  2. Extension of the work permit (if required)
  3. Employment contract/Contract of mandate or to perform specific task
  4. PIT 37 or 40 tax return for the previous year
  5. Certificate about the fulfillment of tax liabilities towards the State Treasury by the foreigner, issued by the relevant tax office (zaświadczenie o niezaleganiu
  6. Documents confirming health insurance or confirmation of covering health treatment costs on the territory of the Republic of Poland by the insurer

2.2 Documents preparation check sheet
Here is the general list of required documents to submit. Generally they are enough to be "accepted" by Mazowsze Province Office. This "accepted day" should be at least 45 days before the expiration of your present visa/residence permit. Even though "accepted", some additional documents may be required depending on your individual Ph.D. program. And it also depends on the character of the office staff who check your documents. Be patient and consult with your supervisor or contact us in any cases for support.

Make a full copy of all documents for yourself for the next time.

2.3 Practical tips for documents preparation

  1. Application form (wniosek)
    Since Jan. 2009, you can fulfill the application form (wniosek) online. Service is currently unavailable.
    Go straight to this page (unfortunately mainly in Polish)
    Search for "Zezwolenie na zamieszkanie na czas oznaczony na terytorium Rzeczypospolitej Polskiej"
    Attention It is an electronical document producing system but not submitting system. You still have to print the output and go to the administration office to submit them.

    When you have a difficulty to see the output pdf file, check your Web browser's "pop up window" setting.
    Anyway, finally, you will have 11 pages pdf file.

    1. Print out 4 copies of filled application
    2. Sign all copies, wherever it’s needed (page 7 and 10) Tips : Signature on page 10 can be your own language as written on your passport.
    3. Glue 4 pictures in each 4 application forms.
  2. Portrait photo Requirements for photo in Polish:
    4 aktualne, nieuszkodzone, kolorowe fotografie o wymiarach 35 x 45 mm, wykonane w ciągu ostatnich 6 miesięcy na jednolitym jasnym tle, mające dobrą ostrość oraz pokazujące wyraŸnie oczy i twarz od wierzchołka głowy do górnej części barków, tak aby twarz zajmowała 70-80% fotografii; fotografie mają przedstawiać osobę bez nakrycia głowy i okularów z ciemnymi szkłami, patrzącą na wprost z otwartymi oczami, nieprzesłoniętymi włosami, z naturalnym wyrazem twarzy i zamkniętymi ustami; fotografie winny być trwale złączone z wnioskiem przez ich naklejenie w miejscu do tego przeznaczonym;

    Requirements for photo in English:
    4 colour pictures 35 x 45 mm, taken in the last 6 months on a uniform bright background. Good focus is required. Eyes need to be clearly visible, head should be visible from top and picture should end on upper shoulders, so that the head will take 70-80% of picture. Person on the photo should not wear any type of cap or dark glasses. Person should look straight ahead with open eyes not covered with hair, closed mouth.

    Nearest place from the Institute to take photo is on Wolska 66.

  3. Passport copy
    Make 3 copies of your passport. Required pages are portrait photo page and all stamped pages.
  4. Registration in Warsaw Capital City Office (Potwierdzenie zameldowania na pobyt czasowy) You must have this document when you prepare documents. Just make a copy of it.
  5. Flat rental contract (Umowa wynajmu mieszkania) You must have this document when you prepare application documents. Just make a copy of it. In case you have the extension contract, make a copy of it, too.
    In case you are staying in students hostel, here are template format. Fulfill it and bring the printout (or MS-word .doc file in your USB flash drive) to Ms. Aleksandra (room 42 in building 9, and ask director's signature on it.
  6. Copies of invoice (faktura) and receipt (dowód wpłaty) Make copies of each invoice (faktura) and receipt (dowód wpłaty) of most recent payments in each cases (flat, electricity, gas, water, central heating, etc.).
  7. Original receipt of the payment (340 zł) Pay 340 zł to this account. See also Sec. 2.5. Name : Urząd Dzielnicy Œródmieście, Miasta Stołecznego Warszawy, ul. Nowogrodzka 43, 00-691 Warszawa. Title „wydanie zezwolenia na zamieszkanie” * Make a copy of this receipt (dowód wpłaty) for procedure inside Institute.
  8. Student certification (Zaświadczenie)
    Here are template formats.
    Fulfill it and bring the printout (or MS-word .doc file in your USB flash drive) to room 41 in building 9 ([map]), and ask director's signature on it. Only 1 original paper is required to submit. No need to make copies of it.
  9. Notification of student stipend (Zawiadomienie o stypendium doktoranckim) Normal students have this "Zawiadomienie o stypendium doktoranckim". Some students funded by projects may have in different way. Consult with your supervisor or contact us. Anyway, make a copy of a document which confirms your stipend.
  10. Employment contract (Umowa o pracę) and
  11. Notification of basic payment (Zawiadomienie o wynagrodzeniu zasadniczym)
    Students who are employed by the Institute (etat 1/4) have these "Umowa o pracę" and "Zawiadomienie o wynagrodzeniu zasadniczym". Students funded by projects may have other documents. Consult with your supervisor or contact us. Make a copy of documents which confirms your employment and salary.
  12. Health insurance document
    Normal students are automatically registered to Polish public health insurance (ZUS RMUA). In this case, go to room 25 in building 9 ( [map]) and ask a printout of this "ZUS RMUA" of the most recent month.
    Some students may be registered in other private health insurance. In such case, make a copy of your contract document and also prepare the "ZUS RMUA" printout.
  13. Justification (Uzasadnienie)
    Additional document to appeal the reason for early application. It is better to prepare when you apply quite earlier than the expiration day of your "D" visa. Consult with your supervisor or contact us.

2.4 Submission

You can send all your application documents by mail (Address: Mazowiecki Urząd Wojewódzki, ul. Długa 5, 00-263 Warsaw). In this case, copies of your passport should be notarized, and it would make preparation more complicated. And because of the reliability of mail process, most students tend to go to one of the places below and pass the application by hand.

In Warsaw, there are 3 places to submit.

    Monday: 10:00 - 17:30, Tuesday: 8:00 - 15:00, Wednesday: closed

    This office is always crowded with applicants. You must come there early if you try to submit your application without meeting appointment. Otherwise, your turn will never come to you until the close time of the office.
  2. Main Bureau of Mazowsze Province Office, ul. Plac Bankowy 3/5
    Room 34, entry B, Monday: 9:00 - 16:30, Tuesday - Friday: 8:00 - 15:30.

  3. Service point of Warsaw Capital City Office at Metro Centrum station Shopping passage, room 2002L
    Monday - Friday: 12:00 - 20:00 (last entry 19:30).

    Service point of Warsaw Capital City Office at Metro Centrum station might be the most convenient. It is open since around March 2008. From experience, your turn will come in around 30 min without appointment (verified in Dec. 2009).
Unfortunately, most of office staff speak only Polish but few speak English. Be ready for it. But if your document preparation is perfect, there will be little problem.

After completing submission, you will receive a piece of paper telling you when you should go to the office in ul. Długa 5 to receive the "Decision" document (You may receive an additional instruction telling you what kind of additional documents you must submit. It depends on the character of the office staff who check your documents. Be patient). Anyway, receiving this paper means that your application is accepted at least 45 days before the expiration of your present visa or residence permit. This is the most important point.

Several weeks later you will receive a recorded delivery letter from Mazowsze Province Office about your "Decision" process. This process and the lettter tends to be delayed. So while waiting for the letter, you can call and ask about the progress of your case (in Polish) Tel : 695 - 67 - (70 or 73)

2.5 Office of Department of Foreigners, Mazowsze Province Office in ul. Długa 5
You will visit this building several times during the procedure (submission documents, receiving "Decision", receiving residence card, etc.). Quite close to "Old Town (Stare Miasto)" area. Tram stops "METRO RATUSZ ARSENAŁ" or "STARE MIASTO", or bus stop "PL. KRASIŃSKICH" would be closest stops.

At reception, tell a staff the section you are going ("B", "C", or "D" etc.), then the staff will pass you a queue number card. Then go to your section and wait in the queue.

There is a service counter next to the reception. There you can

  1. pay for the costs for issuing a residence permit (340 zł) and for the residence card (50 zł) by cash or by credit cards. Remittance costs 2.5 zł. It is convenient and better to pay there because the addressees are already printed in the payment format. Just fulfill your name and address in Warsaw.

Inside the building, there is a free charge information service spot organized by a NGO Association for Legal Intervention (Stowarzyszenie Interwencji Prawnej). English speaking staff will answer your questions and suggest what you should do. (Go to 1st floor, turn right and go, then you will soon see it on the left side)
* This Association for Legal Intervention and Polish Migration Forum (Polskie Forum Migracyjne) opened Information Center for Foreigners (Al. 3 Maja 12, 5F, room 510) in April, 2009. They provide free charge legal informative advice.

2.6 Submission of additional documents (optional)
Sometimes Mazowsze Province Office sends you a recorded delivery letter and requires you to submit additional documents. The letter will be definitely in Polish. And the required documents tend to be "case by case". Consult us for documents preparation and submission. Then, go to
the Office in ul. Długa 5 as early time as possible during the period indicated in the letter. Usually it's "H" section. Check the open time of the Office. You need to bring

  1. The paper or letter ordering you submitting those additional documents
  2. Required additional documents (originals for verification, too)
  3. Passport is not necessary unless required especially

2.7 Receive a letter about "Decision (Decyzja)"
You will receive a recorded delivery letter (Polish) from Mazowsze Province Office, under the name of

  1. Komendant Nadwiślańskiego Oddziału Straży Granicznej
  2. Szef Agencji Bezpieczeństwa Wewnętrznego Biuro Archiwum i Ewidencji
  3. Komendant Stołeczny Policji Wydział Postępowań Administracyjnych
The letter implies that your case is being processed well.

2.8 Paying 50 zł for residence card and receive the "Decision"
Then pay 50 zł for issuing your residence card and
make a copy of the payment receipt.

Before going to the Office in ul. Długa 5, it's better to call and ask whether your "Decision" is really ready or not, because usually this process is delayed. Unfortunately only in Polish. Ask us to call there. Tel : 695 - 67 - (70 or 73)

Then if "Decision" is ready, go to the Office in ul. Długa 5 as early time as possible, because there is always too much crowded with people like you. Usually it's "B" section. Check the open time of the Office. You need to bring

Pass the 50 zł payment receipt (original) and receive the "Decision" document. The Office staff will tell you when your residence card will be ready.

2.9 Renew your registration in Warsaw Capital City Office (zameldowanie)
In principle, it's your flat's owner's business. Ask yours to do it.
If you stay in students hostel, Ms. Aleksandra (room 42 in building 9, [map]) will do it. Visit her and prepare these documents.

  1. Fulfill a form for new registration (zameldowanie)
  2. "Decision" document (original)
  3. Passport

2.10 Receive the residence card (karta pobytu)
At the day (or later) told by the Office staff when you received "Decision" document, go to
the Office in ul. Długa 5 as early time as possible. Usually it's "C" section. Check the open time of the Office. You need to bring

  1. Passport
  2. Old residence card (if you have)
  3. 1 copy of "zameldowanie" (original for verification, too)
Pass the copy of your new "zameldowanie", show its original and your passport. Then you will receive your own plastic residence card (karta pobytu). If you want, you can take the old residence card. But certainly it will be punched. That's the end of procedure outside Institute.

2.11 Procedure inside Institute
Fulfill the template format of application to match your case
prepare copies of receipts (for 340 zł and 50 zł) and copies of both sides of your residence card. Submit them to Ms. Aleksandra (room 42 in building 9, [map]). Then director of the Institute will judge about reimbursement.

3.1 Kinds of Visa
There are 4 kinds of visa. In most cases, students come to Poland with "C" or "D" visa.

3.2 About "D" visa
In English.

"National long-stay visas entitle the holders only to pass through the territory of other Schengen States in order to arrive at the territory of the country which issued the visa that was specified above."

Here, "National long-stay visas" means "D" visa. "D" visa holder can pass other Schengen countries only ONCE, when you COME TO POLAND.

In Polish, it is said more clearly,

  • "W celu odbycia podróży powrotnej, a także każdej następnej podróży tranzytem przez terytoria państw Schengen posiadacz polskiej wizy D musi uprzednio uzyskać wizę tranzytową Schengen, wydaną przez państwo przez terytorium którego tranzyt ma miejsce."
  • "nieprzekraczający 5 dni, bezwizowy tranzyt przez terytorium innych krajów strefy Schengen w celu dotarcia do państwa, które wydało wizę D."
First quote says that in the way BACK to home country, a person who has a "D" visa must obtain Schengen transit visa (A, B) in advance, in order to pass other Schengen countries. Second quote says that in the way COME to Poland, you can visit other other Schengen countries up to 5 days.

Najcześciej zadawane pytania (only in Polish)

Czy na wizie krajowej (D) można podróżować tranzytem przez terytorium Schengen w celu dotarcia do państwa, które wydało wizę?

Cudzoziemiec posiadający wizę krajową oznaczoną symbolem "D" ma prawo do jednorazowego przejazdu przez terytorium innych państw Schengen w celu jednorazowego dotarcia do państwa, które wydało wizę.
Uwaga! Wyżej wymieniona wiza nie uprawnia do przejazdu tranzytem przez państwa Schengen w drodze powrotnej do kraju pochodzenia.

Foreigners who have "D" visa can pass ONCE other Schengen countries in order to come to the country which published your "D" visa. But this "D" visa doesn't validate you to visit other Schengen countries WHEN YOU GO BACK to your home country for holidays or else. So "D" visa is still restricted.

3.3 Visa-free countries
People from countries listed below can visit and stay in Poland without visa (up to 90 days). Unfortunately, Belarus, China, Ethiopia, India, Iran, Russia and Ukraina are not included. Obywatele jakich państw mogą wjeżdżać do Polski w ramach ruchu bezwizowego?

Obywatele wymienionych niżej państw są zwolnieni z obowiązku wizowego do trzech miesięcy: Andora, Antigua i Barbuda, Argentyna, Australia, Wyspy Bahama, Barbados, Brazylia, Brunei, Darussalam, Chile, Chorwacja, Gwatemala, Honduras, Izrael, Japonia, Kanada, Korea Południowa, Kostaryka, Malezja, Mauritius, Meksyk, Monako, Nikaragua, Nowa Zelandia, Panama, Paragwaj, Salwador, San Marino, Saint Kitts i Nevis, Seszele, Singapur, Stany Zjednoczone Ameryki Północnej, Urugwaj, Watykan, Wenezuela...

3.4 Residence permit for a defined period (Zezwolenia na zamieszkanie na czas oznaczony)
If you have the residence permit for a defined period ("Zezwolenia na zamieszkanie na czas oznaczony", valid up to 1 year) in Poland, it enables you to travel and stay within Schengen countries no longer than 3 months. It means that unlike "D" visa, residence permit validate you to visit other Schengen countries when you go back to your home country for holidays.
* Normal students can only apply for this kind of residence permit. It means you have to do this procedure every year.
** Students who married to Polish citizen and Post-docs can apply for longer residence permit.

FAQ

12) Is it possible for a foreigner to travel within the Schengen zone without a visa, if he/she has a stay card in Poland?

After the Republic of Poland entered the Schengen zone, citizens of third countries can travel and stay within the territory of the Schengen zone without the need to have a Schengen visa, on the basis of stay permissions issued by one of the countries belonging to the Schengen zone.

The travel and stay may take place for the period of time no longer than 3 months...

In the case of the Republic of Poland, the stay titles are the following:

  • the permission to reside for the determined period of time‹ This is your case.
  • the permission to settle
  • the permission to stay as a long-term resident of the European Community
  • the consent for the tolerated stay
  • the refugee status
But you can't stay longer than 3 months during 6 months period. It means that if you stay in another Schengen country 3 months then come back to Poland, your residence permit doesn't enable you to go to the country again in the following 3 months.

If you are going to stay longer than 3 months, you may need a visa. It's "case by case", depending on the relation between your home country and the target country. Ask the Embassy/Consulate of the country in Warsaw for details.

3.5 Schengen Area
Now let's review which country belongs to
Schengen Area. Remember that UK and Irland don't belong to Schengen Area although they are EU member coutries.

Uwaga! Wielka Brytania oraz Irlandia są państwami członkowskimi Unii Europejskiej, które nie należą do państw obszaru Schengen. Do państw tego obszaru nie należą także jeszcze Cypr, Bułgaria oraz Rumunia.
